Delfino Product Warranty

Definitions:
“Buyer” means the reseller/ buyer of the Products under the Sales Contract. “Delfino” means Delfino Sdn Bhd, Business Registration No: (1392288-A)

Delfino Product Warranty Claims and Warranty Period:
This warranty is provided by Delfino under the product repair/ replacement sales contract, and the products found during the warranty period are subject to defects [which is caused by workmanship and materials].
The limited warranty period is 1 year from the product purchase invoice date (“Warranty Period”). The warranty is not transferable to third parties.

Product Warranty Coverage:
This warranty is only valid for Delfino Official authorised agents/ buyers/ customers who purchase new products with warranty from authorized dealers or distribution channels of Delfino in Malaysia. 

Battery: 6 months from the purchasing date
Motor: 1 year from the purchasing date
Other spare parts: 15 days from the purchasing date (Depends on the issue)  

Warranty Terms:
1) The Delfino warranty applies to manufacturing defects and is for home/domestic use only. Any form of commercial or small home business use will automatically void this warranty.
2) The warranty is only valid for products purchased from Delfino/ Delfino officially authorized dealers.
3) End users can only hire Delfino official authorized service contractors to provide services related to product warranty.
4) When the product of the dealer/ buyer needs to be repaired, the product purchase slip must be presented to reject the original documents and purchase records. The photos and videos of product defects captured at different angles are the standard.
5) In the following cases, accessories that are not covered by the warranty or accessoriees will be charged additionally even if they are within the warranty period. The warranty does not apply to the following:-
A) The serial number of the product has been changed, tampered with or deleted.
B) The product has been tampered with, misused, negligently damaged and damaged in transit.  
C) The product/ item has not been installed, maintained or operated by itself/ in accordance with the instructions provided by the manufacturer.
D) The electrical product has been repaired, modified or disassembled by anyone else without the official approval of the dealer/Delfino.
E) Defects caused by abnormal voltage or input power from generator.  
F) Defects due to fire, lightning, electrical disturbance, negligence, accidents and other natural disasters or due to deviation from recommended application and installation.
G) Defects caused by man-made or household pests such as lizards, mice, cockroaches, etc.
H) Defects caused by chemical reaction, overheating, water ingress, excessive dust, corrosive environment, such as cement factory, livestock farm, etc.
I) Parts, including accessories, that need to be replaced due to normal wear and tear due to their characteristics during normal use of the product.
J) Cosmetic parts, including cabinets and joints, protected from damage, scratches and aging.
K) The warranty will be void if the device is operated without original or manufacturer recommended parts.

If the product becomes defective within the warranty period, the buyer will need to send the above item including the parts to Delfino/ specific dealer for repair, or replace the defective product with a new/ refurbished/ functionally equivalent similar part, provided that the manufacturer/ Defects covered by this warranty are determined upon inspection by the dealer.

How to submit a warranty claim? 
If the product is found to be damaged or defective after the purchase is completed, it can be replaced within 15 days from the date of receipt (if the product is determined to have not been used, washed and disassembled).
In the event of a defect/ failure of the product under warranty that may result in a claim for repair or replacement under this warranty, the said item must be sent to the seller after the complaint (and within 15 days from complaint date), it has to be submitted to any authorized dealer or distribution channel. After the occurrence of such events and complaints, the original purchase receipt/ sales invoice must also be provided at the same time, supported with photos of the said defeat items, and videos from the various angles.
If the said part needs to be repaired and replaced, the defective part and all related accessories needs to be returned to Delfino official / Delfino dealer for destruction process.

Gentle Reminder From Delfino Manufacturer:
Delfino encourages buyers to check the user manual (if any) accompanying the product and test its operating functions upon receiving of the purchased product to ensure that it is not damaged during transportation and can be operated as usual.

Postage Claim Procedure:
If the product is found to be defective by the seller after receiving inspection (after 15 days upon lodge the complaint, the buyer shall bear the round-trip freight and the cost of accessories which not included in the warranty (if any).
If the received under warranty defeat product is found to be defective after inspection (and it is within the 15 days from the compliant date), hence the buyer can request to claim back the postage fee of send in the said defeat item under dealer’s instructed panel logistic company, after the said item has been repaired or replaced (within 15 days of receiving it) and shall the buyer shall receive the postage claim within 30 days upon each claim.
Delfino/ Reseller reserves the right to exchange the product with other products of similar value if it is found that it is not in stock/ stop its manufacturing, to replace the product.(based on the usage rate count)

Product Warranty Exclusions:
This warranty does not apply to normal wear and tear of the product, scratches complained of after 15 days of receipt of the product, maintenance costs, or any product purchased by the company under any promotional offer or any free gift provided with the purchase.

Further, this warranty excludes any warranty claim relating to any defect, malfunction or damage incidental to or incidental to any of the following:
• Overcharging lithium batteries in all cordless electrical items
• Falling item accessories such as on/off buttons, covers, screws, rubber, etc.
• Improper installation handling, misuse of plugs, adapters, power cords and similar batteries and cables resulting from or negligence, abuse, failure to follow manufacturer’s instructions for installing, operating, cleaning or maintaining the product;
• Non-operational and cosmetic defects, scratches, stains, colour, accessories used on or with the product, external cables and wires, glass and lenses, and included add-on options;
• Unauthorized modifications to the product; altered serial numbers; repairs by unauthorized personnel or image burning;
• All batteries, both normal and rechargeable. External defects such as wiring, electrical connections or piping, ducts, trunking, fittings, readjustment of signal receivers (poor reception), and consequential damages of any kind;
• Repairs required due to accidental or intentional physical damage, spilled liquids, unless otherwise specified in the contract of sale;
• Power supplies, voltage converters and/or applying incorrect voltage to the product;
• Diagnosis of defects not found or noted;
• Commercial use (multi-tenant organization, public rental, for-profit or public use; and
• External causes (including flooding, automobile accident, fire, flood, earthquake, lightning strike, war, invasion, act of foreign enemy, hostilities or actions resembling war, civil war, civil commotion, exposure to water or moisture, or animals, or caused by insects or pests), and any rust, corrosion and similar problems.

Termination and Cancellation Rights: Delfino official appointed dealers may, at their sole discretion, disqualify warranty claims or immediately terminate this warranty and make the warranty void in the following cases:  
• Termination of sales contracts due to disposal or withdrawal of products; and
• Occurrence of an excluded event or breach of any terms and conditions under this warranty. Buyers shall be solely responsible for any accidents, damages or claims arising from the use of the product.

The Buyer/ Delfino Dealer agrees that:  
Buyer may not use this warranty to:
• Submit information that is fraudulent, false, inaccurate, misleading, defamatory or defamatory; and
• Announce or post unsubstantiated statements that may damage the interests or property of Delfino officials or other users;

If Delfino official suspects or discovers that the buyer is abusing this warranty and/or in any of the above ways or otherwise, Delfino official may, at its sole discretion, take necessary measures to prevent and mitigate such abuse, such as restricting, suspending the buyer’s purchase, terminating the buyer’s warranty Claim, delay or remove hosted content, remove any special status associated with buyers, reduce or cancel any discounts, and take technical and/or necessary steps in accordance with applicable law.

Buyer will fully indemnify Legal Liability (and Directors, Employees, Authorized Dealers) against any claim or demand, including reasonable legal costs, made by Buyer or any third party arising from or arising out of his/her breach of these regulations terms and conditions, improper use of this warranty or violation of any law or the rights of third parties.

Privacy:
By providing the buyer’s personal data, the buyer represents that he/she has read, understood and agrees that his/her personal data will be recorded, stored or otherwise processed in accordance with the Delfino Official Privacy Policy at www.delfino.my.

In case of any dispute, Delfino officials reserve the right to make the final decision and have the right to cancel or disqualify the buyer’s order.

By participating in this warranty, buyers:
• agree and accept Delfino’s official terms and conditions completely and unconditionally; and
• agrees to authorize Delfino Officials and their respective parent companies, subsidiaries, affiliates, licensees, directors,employees, independent contractors and advertising/ promotional agencies to use all details submitted by him/ her under this warranty without further Remedies, Unless Prohibited by Law/ Updated. In the event of any inconsistency between the terms and conditions found elsewhere in relation to this warranty (if any) and the terms and conditions here, the latter shall prevail. These terms and conditions shall be governed by the laws of Malaysia and the courts of Malaysia. In the event of any inconsistencies between the English text and other language texts, the English version shall prevail.
